My neighbor built a shed on her property under my tall overlapping tree limbs (the tree is on my property).

She wants the tree limbs trimmed back so that her shed is no longer under the tree limbs. The tree is healthy. Who is responsible for paying for the trimming in the state of MD? The tree has always been there. She didn't see the danger of building a shed there until recently. The branches are beginning to hang more because of the changing weather. Thank you for your response.

A common neighbor irritant. While it is your tree, she is entitled to cut anything overhanging her property line, at her expense. And she can construct right up to her property line, subject to local zoning and setback requirements.

The tree limbs are her problem. She ha the legal right to trim them back, but in a responsible way so as not to kill your tree.

As the two other lawyers said, the neighbor has a right to trim branches overhanging her property. The neighbor cannot trespass on your land in order to do so, and can only trim to the point where the branches cross the property line. Think of the boundary as a line on the ground - the neighbor can trim from the line on the ground up. It is best if you and your neighbor agree on what will actually be done to minimize damage to the tree and to maximize the aesthetic appearance of the tree and your yards.
