The father has been In and out of rehab and jail for the past year. The mother has been caring for the children and now the great grandfather is threatening to try and get custody of the children for the grandmother even though he isnt biologically kin to them. The grandmother started a fight in front of the children with the mother and there is a report filed while the great grandfather did nothing.

A court can grant visitation rights to a grandparent if the court feels it is in the best interest of the child. The court might consider: the custodial parent’s attitude; the possibility of conflict; the nature of the relationship between the child and grandparent; the preference of the child; and the mental and physical health of the parties.
