Can I take action on my ex-wife not paying her half of co-owned land taxes.

My ex-wife and I own land together. Our names appear on the title as My Name AND Her Name. We have an agreement to pay the taxes 50/50. She has not been living up to her end and there is now a lien on the land. Can you take action to remove her from the land if I am the only one paying the taxes? What are my options?

Offer to buy her out, but pay the taxes in the interim so that no tax certificates are issued. If you she won't sell, file ajn action in partition. This isn't DIY. Find a good litigating real property lawyer in Orlando or the county where the land is to file the case. She will then either be forced to sell to you, or the other way around, or it will be sold on the courthouse steps. Good Luck d

It depends what your agreement says. If it's verbal, good luck enforcing it. IF written, then the contract will say what shes responsible to do and what happens if she doesnt. If she doesnt though you will need to cover the taxes even if suing her as a tax certificate will issue and you could lose the house to a tax auction. You could then potentially sue her for her half you had to pay out. Or as stated, you can buy her out or agree to sell the property (or partition if only 1 wants to sell)
