My husband of 33 years is filing for a divorce. I am blindsided. I do not want a divorce and need advice.

My husband and I are both in our early 60's. He had open-heart surgery last year and a personality change. Our young adult children have noticed this also. He is spending money like water, took money out of our 401K and opened a separate checking account in his name only. Visited multiple lawyers and put a deposit down on a apartment for November. Purchased new furniture for it. Very focused on his health. Has a personal trainer for 650 month and buying anti-aging products, new exercise clothes. He tells me I am stressing him out. That is why he wants a divorce. I do not know what I am doing. He has done things behind my back. I have suggested counseling for us and he will not go. I am in shock after all these years. Please advise. Is there any way I can stall this if he files.

You need to speak to an experienced local divorce attorney IMMEDIATELY. Your husband is taking steps to begin a new life without you, and it seems that he is dissipating marital assets in order to begin that life. Find an attorney NOW before he disposes of all of the marital assets.

I agree with the previous poster. You need to see an experienced family law attorney IMMEDIATELY. An attorney can explain the law to you and help make sure you are protected. For example, it seems he may be improperly dissipating marital assets--a lawyer can help you stop that from happening. I know you are shocked, and don't want to be divorced, and also probably don't want to spend the money on a lawyer, but this is very important. Please don't ignore this and hope it will go away or take longer if you don't respond--it won't, and if you don't take the proper legal steps to protect yourself you will be in default and it is much more likely that the court will give him pretty much everything he asks for.

Unfortunately, if he wants a divorce he will get one and the courts cannot stop him. There are ways to work with him outside of court and a family law attorney can advise you as to what options you have.
