Can I get full custody?

Business 2 views 3 answers
My ex husband and i were divorced April 2014. I want to get full custody of my children for the fact that since he got remarried in June, (which he lied to me about) he has not responded to text messages of my children, fails to tell me anything about his new wife (as I feel I should know because she lives with MY CHILDREN) and I came to find out that she goes to "school" as my children told me, its really adult detention as this is what they told them, every Tuesday until 8pm. My son is 12 going on 13 but my daughter is 9yr. I know with my son he can decide where to go but my daughter is not old enough too, however they both want to stay there because they like the school and tell me everything is ok. I do not feel comfortable. If I fight would I get full custody?

You have not described anything that would absolutely guarantee any change in possession orders. You are divorced now. You are both free to marry without 'reporting' to the other parent.

Take your orders to family law counsel regarding the desirability of returning to court. Texas has no status called full custody. If you have the right to designate your children's residence you have the custodial right in your present order. He is not required to tell you anything about his new wife. From objective information from your children and what you can glean from others, you must determine if they are at any risk or danger from that person and decide whether to file to modify orders. You can obtain her name and date of birth and you can do some independent background check on her. He also is not required to respond to text messages, but perhaps this has some innocent explanation. Talk long and hard with counsel before deciding whether to go back to court. Yes, you can have something good happen or bad.

It is imperative that the attorney knows the reason why he has primary custody and the type of custody that is Sole or Joint. It is always difficult for a female to lose primary custody. If there is a material reasons than the attorney needs to know if the circumstances have changed since the divorce. At that time you can decide to fight for custody.
