Dear Brooklyn Property Owner: If by eviction notice you meant a tenancy termination notice you prepared to end a month to month tenancy, the tenant has until November 15 to move and if the tenant does not move out you then must start the summary holdover proceeding. You selected an odd date for the tenancy termination, but that does work if the tenant has an odd rental month with the rent due date on the 16th so that the rent month runs from the 16th day of one month to the 15th day of the next month.

It is not clear what you mean by "eviction notice?" Was this a notice telling the tenant to leave? Did you go to court? Is there a judgment? Did you get a Warrant? Is the Marshall's Notice the Eviction Notice? The tenant is free to request more time at almost any time in the process. It would be hard to tell whether or not they might get it from your question.
