Mom has cancer.

My mother got a dx of inoperable lung cancer yesterday and I would like to sue the tobacco companies especially the one that make Marlboro. Why is it that a toddle can be killed in a jumper seat and there is a massive recall but when hundreds of thousands are dying from cancer (mostly due to smoking) the tobacco companies get a free pass. I thought the governments job was to protect us from this kind of stuff. Alcohol companies should be punished as well and congress person who wants to legalized marijuana should be put to death. I myself am a pot smoke as I have cancer and HIV but I am not for it being legalized as a recreational drug.

You should contact a lawyer that has successfully sued the tobacco companies immediately. Please feel free to contact me should you desire a referral to such a lawyer here in Miami.

Sorry for both of your situation's. There has never been a tobacco verdict (and there have only been a few successful ones) affirmed on appeal. Please double check this. Do contact an attorney, but the sad reality is that money buys all things that money can buy.

Tobacco cases are hard to win for many reasons, and most people who sue tobacco companies do not recover. However, some have been successful, so you ought to look into it. Part of the problem withing a tobacco case is a legal doctrine lawyers call assumption of the risk. The thinking is that people know that cigarettes are bad for them, so they should not be allowed to sue if they knew what they were doing. Thus, if your mom became addicted to cigarettes before the first warnings came out, then she will have a better case. I hate tobacco companies and I hope you win. There are Florida lawyers who have been successful, so you ought to look into it. The initial consultation will be free, so you have nothing to lose.
