How long do I have to wait until I can file for an abandonment divorce

2 views 3 answers
My wife and I spit up in June of 2013. I filed for divorce in Nov 2014 sent her the documents because we agreed to no contest. I told her she needed to go get it notarized and that became the last time I was able to get in touch with her. I don't have any of her contact information. I filed my divorce in Bell county and now live in Dallas county.

You should retain family law counsel in Bell County. Depending on whether there are children or any appreciable amount of community property determines whether you can serve by posting at the courthouse or publication service in a Bell County newspaper. You must do an affidavit of due diligence to support either form of service. If you know a last-known place of abode you would attempt service there and then Rule 106 alternative service there if necessary.

Find out whether the case you filed is still active. If it is, you can continue it. Otherwise you'll need to file again. Hire a Family lawyer. They may have tools to locate your ex. Otherwise she can be served by publication. Talk to your lawyer about whether the court can waive an ad Litem for her.
