What type of professional conducts a child custody evaluation?
Anonymous2 views2 answers
I have filed a motion to modify my child's visitation with her father. He has demonstrated erratic behavior, poor judgment and poor management of his anger. I have a 1 yr restraining order against him issued September of this year, and I have serious concerns about my child's safety while in his care. I have no knowledge or evidence of him harming my child directly, beyond the exposure to his volatile screaming rants and verbal abuse towards me, her mother, in my daughter's presence.
I have been told that a family court judge will not and cannot constitutionally order a parent to have mandated psychotherapy or a psychiatric evaluation, is that true? Is a CCI conducted by a psychologist, MFT, or LCSW? Does my child have to have minor appointed counsel in order to get a CCI?

You need to at least speak to a family law attorney with substantial child custody trial experience, with ALL of the facts, BEFORE you get to court; there aren't really "do-overs" if this doesn't go the way you expect.. What you "have been told" is partially wrong, and partially right. If you're asking for a custody evaluation, you need help in figuring out who should do it, and HOW they should do it.
I don't know who you've been talking to, but they are incorrect. As for a "CCI" I think you mean a 730 evaluation, and they are conducted by specialists approved by the court. Mental health professionals.
No, you don't have to have minors counsel to request the eval.
