Do I need to file for a hearing after the respondent answered with no objections in a modify parental time sharing?

My ex has legal custody of our son who has lived with me for a year. I filed petition to modify parental time sharing and he answered within the 20 days with no objections to my petition. Do I need to file for a hearing before judge/magistrate or will a court date be set automatic? If automatic how long does it take generally and is there a way to speed up the process since we agree to the terms?

Nothing happens automatically. You will either need to schedule a final hearing, or you can prepare a Supplemental Final Judgment setting forth the amended timesharing provisions and submit it to the judge with a letter explaining there were no objections to your petition.

I agree; the Court will not do anything automatically for you. You should set the case for a hearing. If both of you are without attorneys, then there should be a case manager who can assist you with doing that. Or you can hire an attorney to get it set (which would be pretty cheap) to ensure that you get it all done properly. Best of luck! If this answer helps, please click the helpful button.
