I been work at McDonald for awhile and i been carrying mase on me my protection. But then the head manger found out that i was carry it and told me that im not allow to carry it on McDonald property anymore. But if i do not work at the time and i still carry it on me. And she heard about me still carry on the property can she still fire me for it. Or is it better to just not to carry it on me at all when i go down to McDonald.

People get fired all the time for things they do when not on the clock, and unless there is some sort of exception (i.e., contract, statute, public policy) it is totally OK. Just don't carry it on the property at all or you are risking your job.

Don't carry the mace on the property. It's a weapon, and most McDonald's franchises don't permit their employees to carry weapons, regardless of how long the employee has been there. Ohio is an at-will state, meaning that you can be terminated for any or no reason at any time. Bringing a weapon (mace) onto the property when explicitly told not to do so by the manager would definitely be grounds for termination.

Yes, you can be legally fired for your conduct while off the clock. It happens all the time and (with a few exceptions) it is generally legal. And it would be legal to terminate your employment for bringing mace on company property.

Ohio is an at will state. You can be fired even if it is a mistake by management. There are no exceptions here and as a general counsel I would not permit it on my client's premises. Sorry. Sheldon P. Starke, Cle.,OH
