How to settle an accident claim dispute?
Anonymous2 views3 answers
Few days back I met with an accident. I was crossing the road in front of a standing traffic, with the permission of the driver, on the lane nearest me. But before I could cross the road completely, the driver on the other lane suddenly started his mini-truck and slammed by car's trunk. No one was harmed, so we didn't call police at that time, but I reported a crash report 2 days later (only when my insurance company said, they need it).
I have not taken coverage of my car in the insurance. And moreover it was completely the other driver's fault. But when I contacted that driver's insurance company, they said that the driver has given an entirely different statement stating he was not guilty.
What shall I do now to get the money for the damages of my car? Shall I proceed to sue?

Do you have liability coverage with your insurance carrier? If so, you need to notify your agent about the situation and let your insurance carrier deal with the other driver's carrier. Any witnesses to the collision? Tell your agent if there were any witnesses that provided you their contact information.
You should turn it over to your liability carrier for a defense. From your post, you, not the driver of the truck, was at fault. You have to be able to clear the intersection safely and completely before you enter.
