We were a lesbian couple. We seperated under extenuating circumstance. she was very abusive and unstable when she left me I was homeless for nearly 6 months. I found out today that she got remarried and we are yet divorced. I wanted to know what penalty does a class e felony hold in NY. I currently live in NJ and I would also like to hire an attorney. So I can file for a divorce? We have yet to divorce as I couldnt find anyone to give me any information. I know as of last year NJ passed a law for same sex divorces were legal or something of that nature. I couldnt find anyone to provide me with the correct information as to handle this matter. Now I find she has remarried and I would like to also have that option. I am going to pursue having her arrested for this crime she has committied.

In NJ same sex unions are called civil partnerships and a petition for dissolution can be made in the family court of the county where you live. You can find some further information at this website:http://www.aclu.org/lgbt-rights_hiv-aids/frequently-asked-questions-about-new-jersey-civil-unions-practical-guide-same-s You should immediately protect yourself by getting a restraining order against your ex which you should have done the day she forced you to leave. A violation of a restraining order can lead to incarceration. I am not sure what the penalty is for entering into a new civil union when the first one has yet to be dissolved. I do not think the state will apply the laws of bigamy because this is such a new area of the law. You can discuss your legal issues with NJ family lawyers who work with gay and lesbian partners. Their information is available on the avvo lawyers directory. On my profile there are several legal guides. I recommend reviewing the following which may be helpful to you: Hiring a lawyer; Is it Legal? Is it Illegal?...Understanding the different court systems; Introduction to Legal terms used in litigation; Limitations on a Lawyer’s License: What a Lawyer Can and Cannot Do……………………………..………………………….. Divorce and Legal Separation in General and How It's Handled in New Jersey Financial Dos and Don'ts after a Divorce (written by Attorney Gabriel Cheong) LEGAL DISCLAIMER………………………………………………………………….. Mr. Sarno is licensed to practice law in NJ and NY. His response here is not legal advice and does not create an attorney/ client relationship. The response is in the form of legal education and is intended to provide general information about the matter in question. Many times the questioner may leave out details which would make the reply unsuitable. Mr. Sarno strongly advises the questioner to confer with an attorney in their own state to acquire more information about this issue.
