I Was Arrested 2 Years Ago For Petty Theft It Was My First Offense, I Received an ACD And I Stayed Out Of Trouble For 2 Years. I Recently Got Arrested For The Same The Crime And I Just Want To Know Is My Case Going To Trial & Im A Going To Jail. I Don't Want To Go To Jail! It Was Stupid Thing I Did.
You should hire an attorney to represent you on this. Even though you got the prior ACD, it may still be possible to get a reduction of the charge and avoid jail time. Speak to an attorney ASAP to discuss your options.
Luckily, you were arrested in NYC. There are plenty of places where jail would be likely, but NYC is not among them. Perhaps you should re-think your life style though because eventually, even in NYC there wil come a time.
You could go to jail for upto one year but the odds are against it since the prosecutor is likely going to offer you a plea bargain that does not include jail time to avoid the necessity of a trial which your lawyer will wisely convince you to accept.
