Immigration and criminal probation
Anonymous1 views2 answers
In 2008, I was put on a 2 year probation for a misdemenor charge stemming from 2007. My probation is getting ready to finish up and I'm getting anxious. I haven't heard from immigration before ,during or after sentencing nor since I've been on probation. What is the likelihood that they are just waiting for me to finish up probation and as soon as I'm done send me a Notice to Appear? Should they have contacted me years ago already or do you believe once I'm off probation I have a better chance of finding myself in proceedings than I did while I was on probation?Does probation kind of serve as a safety from immigration?
There are several reasons why you have not yet received a Notice to Appear.
1. Prosecutorial discretion - USCIS is not going to do anything as you are not a priority to them
2. The NTA was issued but just not served because they do not know where you are. You can check your A number by calling 800 898 7180 assuming you have an A number
You never mention your status. If you are a permanent resident, they may not know about your probation unless you file for citizenship.
What has been your previous contact with USCIS? You need a complete consultation with a competent immigration attorney.
This communication is intended as general information and not specific legal advice, and this communication does not create an attorney-client relationship. Consultation with an experienced competent immigration attorney is often the best way to address the complexities of individual immigration issues.
