I have already applied for my N400 and case is in line for an interview. I forgot to mention a lawsuit that my ex-employer filed

My ex-employer filed a lawsuit against me in 2012 for breaching non-compete. Case was dismissed as I signed an injunction letter - all within two weeks. The injunction expired in 2013. I forgot to mention this in my N400 though I mentioned my minor traffic violations. I filed my N400 in September 2015, completed Biometrics, case is in line for interview for last 2 weeks. Question: 1. Will I ever get an interview (as I forgot to mention the above lawsuit)? Will scheduling interview be delayed due to this? 2. If interviewed, can I disclose the information there? I have ordered for certified copies of court disposition - hoping to take with me to the interview. Should I send anything prior? 3. Just based on this mistake, will case be denied? What other possibilities? I appreciate your help!

A lawsuit is not an arrest, citation or conviction. You had no need to declare it. They are not interested in who is suing who. As long as you mentioned all your brushes with law enforcement including traffic citations, you have at least met that requirement. Good luck at interview.

The N400 asks about convictions, arrests, citations. What you are describing seems to be a civil suit? Correct? I am not sure how it applies. They will still have the interview. Rescheduling will delay it. If the officer asks about and certainly you yourself can (should if applicable) volunteer and provide the information (but I am not sure how this is applicable unless I am missing something.) In general if you forgot to put like a citation on the N400 as long as you disclose it at the interview with a certified disposition of the matter, it should be fine and not a reason for dismissal. I would just talk to an immigration attorney to get prepared for the interview and have peace of mind. Good luck to you.

Normally Civil lawsuits are not part of the immigration process.
