I received a speeding ticket within the city limits of Knoxville TN in my personal vehicle. The Narrative section of the citation states "Speeding 54" but the officer chose to give me a Violation of 45 in a 40MPH zone. This is my first speeding ticket in TN and also in 20 years. I drive a commercial vehicle for a living and have a lifetime of miles under my belt without any citations to speak of. I have actually taken 2 work-related defensive driving courses as part of the hiring process for previous jobs, The NSC Defensive Driving Course for Professional Truck Drivers and The Smith System. My goal is to keep any points from going on my driving record but I am unsure how to proceed in court. How should I plead? Can the ticket be dismissed based on my record? Please advise. Thank you.

Some city courts will dismiss cases where the ticket shows file miles over, and officers often do this to cut offenders a break. However, there is no guarantee. You might check if there is an attorney who handle Knoxville speeding tickets, as city courts can take much longer than smaller courts, and having your attorney showup for the ticket may result in a better chance of full dismissal.

While this is a State specific matter so I would defer to a TN attorney, it has always been my opinion that you should invest in an attorney to contest these tickets. First, there is more at stake than just the fine and points since insurance companies use these to raise your rates and, second, it keeps the cops busy so they can't write more speeding tickets.

Consult with a TN barred attorney who handles Motor Vehicle cases. They may be able to give you some useful advice regarding your speeding ticket. Good luck

An attorney here in town is your best bet to ensure that this does not go on your record. Many times these low level traffic offenses can be handled without any effect on driving records. I recommend you seek a consultation with an attorney in town, many attorneys like myself offer free consultations.
