Im 16 and my boyfriend is 19 we were cuaght by the police at 11pm having sex behind a park ( the park wasnt closed) in the car. No one was there we were secluded. The officer gave us pink slips about summons and it says title of offensive: sexual activity in park. Then the only code it has on it is in violation of section 1-04 subsection L8 so 1-04 (L8). The police said i was lucky that i wasnt in that much trouble but isnt a summons bad? And he said i can go alone without a parent to court bc im 16 but i want to double check. So my questions are... Can i go to court alone being 16 in nyc? Because my parents cant find out. Im applying to colleges will this be on my permanent record? And what will most likely be the outcome? A fine of 200 or will we go to jail?
You are charged with a misdemeanor. You are not going to jail but you don't want to end up with a criminal record for life. I suggest that you hire a good criminal defense lawyer. There may be a way to get the case dismissed.
You're charged with a crime and your boyfriend is very lucky he wasn't arrested. It is illegal to have sex with someone younger than 17. You should definitely tell your parents ao they can hire an attorney to make sure you don't ruin your chances at college.
I suggest you review Rule Regulation 1-07 which can be found at:
http://www.nycgovparks.org/rules/section-1-07
I suggest you exercise your right to counsel and your right to remain silent. This is not a matter you should hide from your parents it is far too serious.
Your section 1-04 L states:
Disorderly Behavior
It shall be a violation of these rules to engage in disorderly behavior in a park. A person in any park shall be guilty of disorderly behavior who:
1. enters or leaves any park except by designated entrance ways or exits, or enters or attempts to enter any facility, area or building sealed, locked or otherwise restricted from public access; or
2. climbs upon any wall, fence, shelter, tree, shrub, fountain or other vegetation, or any structure or statue not specifically intended for climbing purposes; or
3. gains or attempts to gain admittance to the facilities in any park for the use of which charge is made without paying such charge; or
4. engages in any form of gambling or game of chance for money, or tells fortunes for money; or
5. interferes with, encumbers, obstructs or renders dangerous any part of a park or park road; obstructs vehicular or pedestrian traffic; or
6. engages in fighting or assaults any person; or
7.. engages in a course of conduct or commits acts that unreasonably alarm or seriously annoy another person; or
8. engages in any form of sexual activity; or
9. engages in a course of conduct or commits acts that endanger the safety of others.
You are accused of violating number 8, engaging in any form of sexual activity.
You should not hide this from your parents. Yes, it will upset them. Yes, it may be rather embarrassing.
But yes, this is serious and you will need their help to secure counsel.
