Can I gain full custody of my niece?

3 views 3 answers
So my sister has just informed me that my youngest niece has been taken away from her. This is her 3rd child that has been taken away and is the 9th child in our family that is going through the system. I told her that I want to gain full custody because I can't see another child in our family being taken away. She said that she has already been adopted, but it was an illegal adoption because she never signed her rights away. Is there any way I can still gain full custody?

Were your sister's rights terminated by a family court judge in an Article 10 proceeding?

Hello: Adoptions in NY can only be done by court - both parents must consent to the adoption. That is one way to terminate parental rights. Parental rights can also be terminated by Article 10 neglect proceedings. See http://nysccc.org/fostercare/legal-issues/nys-family-court-proceedings/grounds-for-termination/ You may want to consider guardianship - speak to CPS if the child has been "taken away".

Hello, Consult with a local attorney that specializes in guardianships and who can evaluate all of the facts and interpret the NY laws.
