Your Q is not clear. That is a problem with not talking to a lawyer. Why not call one locally?

It sounds to me like you are asking whether you can still be evicted even though the landlord accepted a portion of your rent. The answer is yes, you can. You paid $250 out of $350, but still owe $100. If you had paid the entire amount the analysis would be different - but because you are still delinquent in rent the landlord can evict you (assuming he/she follows the proper procedure of first giving you a 3-day notice then filing with the court, etc.). If the eviction has already been filed then there is probably a hearing scheduled - be sure to attend the eviction hearing. You may be able to give the landlord the remaining $100 and have the eviction dismissed. If you do not show up to the hearing the landlord will probably be granted the property back and will begin the process to set you out. It would be helpful to have an attorney represent you throughout this process - you can search for a local landlord/tenant attorney on . Good luck, and I hope this helps.

The timeline here can be important, as well as missing details - have you since paid (and the landlord since accepted) the remaining due rent?
