Ok, my spouse is a permanent resident for 5 years. During that 5 years, she stayed out of country for 181 days, does it go beyond 6 month in her maintaining continuous residency in USA? Are we safe to apply for Citizenship for her or should we wait 5 years from after her trip that was 181 days?
Your wife may apply in 4 years 1 month after she returned from a trip that lasted more than 6 months. 181 days is such a trip. Of course, your wife has to be otherwise qualified.
The 6 month absence from the U.S. will cause your resident spouse to wait an additional time ( 4 years and a day) before the FORM N-400 can be submitted. You may want to visit with an experienced immigration attorney to properly analyze the case.
