If he won't move out, what actions do I need to take to have him move out?

My husband and I have been married for 3 years. I own the home we live in. I pay all of the bills. I want to request a divorce and have him move out.

You should file for divorce as soon as possible. the increase in the value of the house and hr reduction on the mortgage note are marital assets and the longer these increase without you filing, the more you may have to pay him when you divorce. Once the divorce is final, or sooner, he will have to move out.

I agree 100% with Mr. Peppler. Once you file for divorce, you can file a motion for temporary exclusive use of the marital home. The Court may require you to attend mediation before it will even hear a motion for temporary relief. So the sooner you begin the sooner your can get him out of the house. Has there been any domestic violence committed by him on you? If so, you might be able to file a petition for an injunction.
