A Borderline's reaction to a DWI
Anonymous2 views3 answers
Has any DWI lawyer ever dealt with a case in which the client had "borderline personality disorder" as a psychological disorder and was on an emotional rollercoaster when pulled over by the officer and charged with a DWI?
-If so, what was your intake on their video? Does it explain their emotionally dysregulated behavior?
A Borderline's reactions and emotional toll of situations are not taken seriously by law enforcement. I am wondering if bringing up the psychological issue and prescribed medication would benefit if the case was taken to trial... Or would I be shooting myself in the foot?
Any comments would be appreciated... Thanks!
A top notch DWI lawyer will know how to handle this issue. It will more than likely require both an expert witness and the treating psychiatrist/psychologist to testify but these are issues that great DWI Lawyers deal with on a regular basis. Explaining that the behavior on the video is not the result of intoxication, but merely evidence of psychological problems is common. The tough part is bringing out the right testimony and having the proper experts that can support the defense theory. You need to contact a DWI Lawyer immediately and begun working with that person to get what you need to defend your case.
You need a DWI specialist to handle the case. Since we haven't seen the videos or investigated the case, we cannot give you a meaningful answer to your questions. If you already have a DWI specialist representing you, listen to the advice you get. If you do not have a specialist representing you, get one immediately.

As Mr. Case noted, an expert witness can help a jury to understand that what they are seeing on the video is the result of a psychological condition rather than intoxication. If there is behavior on the video that could be seen as signs of intoxication then you better believe the State is going to use that against you. If there is a reasonable explanation for that behavior other than intoxication the jury must hear it. You should definitely hire an experienced DWI trial lawyer to help fight the case.
