Can I file a cease and desist letter against my husband's attorney?
Anonymous2 views5 answers
I am in the process of trying finalize a dual, no-fault divorce in NYS. This has been going for well over a year. My husbands attorney sends letters to my attorneys which get forwarded to me. These communications contain threats of more legal action and name calling, as well as sarcastic and demeaning comments. I have received emails from him directly, at my home and my workplace on a weekend. I was severely abused in my 24 year marriage and have been medicated and in therapy for 18 months. He and my husband know this and also know the impact his threats and remarks have on me. Is it feasible that I can have an attorney send this lawyer and/or my husband a cease and desist letter? How can I put an end to this behavior? My husband told me his attorney is using my mental health condition from the abuse against me on purpose to give them an advantage. Any info will be appreciated.
If you have an attorney, I do not understand why you are online asking strangers what to do regarding legal options associated with your case----use your attorney!
I concur with the recommendations of my distinguished colleagues. Since you are represented by counsel you need to have your attorney handle this situation rather than asking other attorneys. Good luck.
Your lawyer certainly can and should send your hisband' s attorney a letter requesting that he cease and desist engaging in any direct communication with you outside the courtroom.
your attorney deals with this. I think you misunderstand what a cease and desist letter is For. Your husband and your husband should not be contacting you. You get emails, delete them. Have your attorney deal with the comments. he certainly can ask for civility.

Terrible situation. Neither your husband and/or his attorney should be doing this. Please speak to your attorney or get a new attorney because your counsel should be doing his/her best to make this unethical behavior stop.
