What the best defense? 2C:12-1b(2)
Anonymous6 views4 answers
I was charged on Christmas day with 2C:12-1b (2). The cops took pictures of the cuts but I also pressed charges on my assailants ( 2C:12-1 simple) and I was the only one to go to the hospital ( we lived together ). It was in self defense and they were inebriated - pictures -. I made the 9/11 calls and they arrest me for the knife - I got the 9/11 calls thru the OPRA Act -. None of them went to the hospital. The hospital toxicology report cleared me - I was sober -. I just went to CJP last week and they did not kick it back to the magistrate. It has not been indicted yet either. My assailants are illegal and we just want a mutual dismissal - mutual fighting -. I want to know possible defenses for dismissal or a not guilty outcome and if they need to be deported them (5 ppl ) for me to be free, that is fine. I am out on bail and we had prior problems - never police involved and never this magnitude -. This happened because of a tax preparation I did for one of them and he didn't receive his refund -money from the IRS- and subsequently all 5 jumped me -2 roommates and 3 of his family members- .
Everything you have just described sounds like the foundation of a solid defense. You just have to be patient. If the prosecution indict the case all of these factors can be used effectively. Self-defense, dirty victims a sloppily charged case all will be to your advantage. You just have to be patient and wait for your day in court. This case is not as important to the state as it is to you. They have a thousand more just like this. Too many people make it easy on them by pleading to these type of charges. Good luck
The best defense is to get a good criminal lawyer because once you lose you can't go back in time and win. It sounds like you know some law, but that can be a double edge sword as your probably smart enough to know that you don't know what you are doing and realize that is not going to be downgraded on your own unless you have someone championing your cause.
The best defense is retaining the best criminal defense attorney you can afford. I concur with the recommendation of my distinguished colleague attorney H. Scott Aalsberg. My learned colleague has provided you with a comprehensive and eloquently written statement in answer to your question(s). To properly answer your questions and address your concerns, the best way to handle this is with an in person consultation with an experienced attorney. You should carefully read the answers which you were furnished by my colleagues to help you decide on an attorney. Good luck.

It sounds like you have multiple defenses. Your best bet is to retain an experienced criminal defense attorney ASAP. The knife and "unlawful purpose" is the reason the likely 3rd degree is not being downgraded. Statements from the 5 supporting your self defense claim would certainly help.
