I'm a bridge builder, that had a accident at work a couple of years ago, I fell off the bridge into the water and broke my tibia and fibia in my right leg, it wasnt my fault, I was tied off to something the company had me tied off too, and come to find out it wasnt properly secured so it came with me with the fall. I didn't no any better and settled with workmans comp for about $8.000 and they covered my medical bills.

Recovery in your case is dependent on the facts surrounding your work place injury. Workers' compensation is the exclusive remedy against your employer but not a third party. RE-opening a claim is very difficult but can be done if there are grounds. A personal telephone consultation is necessary to advise you any further. Many firms, like ours, handle WC claims all across the state. Good Luck

Way more facts would be needed to fully answer your question. Workers comp is a very specialized area of law, and can vary greatly from state to state. Based on your injuries and very meager settlement amount, you should look into your options. Absolutely use the Find a Lawyer tab to find a work comp attorney in your state. A consultation to discuss your options should be free. Best of luck.

Your exclusive(only) remedy against your employer and coworkers is the workers compensation settlement you made. If another subcontractor or its employees caused your injury, they are not covered by your employer's workers' compensation insurance. You have up to three years to bring a personal injury lawsuit for their carelessness in Montana.

My office specializes in Workers Compensation and industrial injury claims. I have too many questions to be able to provide any idea on whether you have another claim. It is very worrisome that you fell off of the bridge despite being tied off. There may be a General Contractor who was responsible for safety on the construction site. Feel free to call us at 406-587-3720. Lucas J. Foust
