My wife is on H4 with EAD based on my approved I140. She intends to start a business (LLC) by importing from other countries like India and China and Resell in the US.
Yes, she can start her own business, and there is no provision under US immigration law that would prevent her from importing goods and selling them in the US.

Yes. She is legally authorized to establish her own business and be self-employed with an EAD card granted to her on the basis of her being in H-4 status and her spouse having an approved I-140 petition with a visa priority date that is not yet current. With regard to the importation of goods from India and China, and whether there are any restrictions that would specifically apply to a foreign national residing in the United States in a non-immigrant status, I am not aware of any, but my area of practice is immigration law. I therefore advise you and your wife to verify whether there might be any restrictions by contacting an attorney specializing in IBT (International Business Transactions) who has knowledge of import laws in the United States. Import laws, and the classification of imported goods for the purpose of imposing import duties, can be very complex area. Hence, you and your wife would most likely benefit from contacting an attorney who practices law in this area, even if there are no special restrictions applicable under U.S. law to foreign nationals importing goods into the United States.
