How do I get him to be able to come live with me?

I have been divorced for about 9 years now. We have 3 children together, 20 year old and in college an 18 year old who will graduate high school this year and a 13 year old. Upon our divorce we agreed that they would be allowed to move out of state to Colorado as her new husband who is in the Army was to be stationed there. Since arriving in Colorado my youngest son has had numerous amounts of health problems, dr. visits hospital stays, and just recently undergoing a surgery du to persistent bloody noses. The times in the summer and winter that he is with me in California he never has these health issues and is very happy. Also his step dad is set to move alone to Georgia for a couple years and there will be no family left but his mom. He has both sides of his family here since this is where everyone is originally from

You would have to file a request for order with the court to modify the current custody orders. Changing custody is very difficult to do and you should consult with an attorney before you file anything. You might also want to talk with your Ex and see if she is agreeable to some change.

You will definitely need to file a Request For Order to change custody, but you want to be prepared prior to filing the motion. It is difficult to change custody especially since he has been in the primary custody of his mother for 9 years. You should definitely get his medical records from doctor to support your claim that his health issues are due to the climate in CO. Secondly, you should seek a family law attorney because you will definitely need to convince the court that it is in your son's best interest to move to CA with you.

You will need to file a Request for Order requesting a modification in custody and visitation. This may be an uphill battle unless you can show that there has been a significant change of circumstance since your agreement that would warrant a change of custody. Also, if there is proven signs of neglect as it relates to his health, you want to provide documented evidence of such. Good luck to you!
