Can I have the trial moved to Mobile AL

7 views 3 answers
I'm trying to get a divorce. My spouse and I lived in Millry AL. We separated and I moved to Mobile AL June 2, 2014. I don't feel like I will get a fair trial in Washington County because my spouse and family are natives of the area and I am not. Her aunt is the district attorney's secretary and her grandfather hunts with the judge.

I am sorry to learn of your unfortunate situation. In order to determine if your request can be accomplished, you will have to consult with an experienced AL matrimonial attorney. Use 's Find a Lawyer tool to select a qualified attorney. Good luck.

If I were you, I wouldn't get all hepped up about who your wife does or doesn't know. If you are the one planning to file for divorce, you're probably going to wind up in Washington County. If your wife is the one filing for divorce, you'll probably be able to end up in Mobile County. Venue for a divorce is generally going to be in the county where the defendant resides. Now, you really need to assess whether it makes sense to worry about this. If all you have to worry about is child custody and support, those decisions are pretty much resolved for you. Child support is going to be entered in accordance with Rule 32 guidelines. And if the kids is with her now, it is unlikely that the judge is going to change that since you are the one who moved. If the judges know your wife, that might work against her as much as for her...depending on her reputation.

Mr. Scully has given you good advice. He even hinted at the fact that a judge might lean away from her because of ties with the family. You presume the judge to be crooked. I have seen judges give decisions that I thought were stilted just to make clear that the judge did not favor someone he was familiar with. David
