Most probation have standard terms against using medical marijuana. Probation departments usually have a blanket stance against it period. That means it is up to the judge. Some judges are more lenient and sympathetic to medical marijuana than others. That is where having a lawyer that knows your judge really comes in handy. You can first ask your PO but I imagine they will say no. That means you will have to file a motion with the judge. It is probably a good idea to have an affidavit from the doctor (or better yet, have the doctor appear in person before the judge) to explain why you need the medical marijuana and why they are no other alternatives. I would strongly urge you to not try this on your on. Retain an experienced criminal lawyer and look for one that is familiar with your particular judge.

Before doing something like that you should get permission from the court or the probation department.

Check with your probation officer and/or the judge. Many will not allow your plan.

I agree with the posts, just because you have a valid MMMA Card does not mean you can smoke while on probation. Judges/Courts can restrict your otherwise legal actions (common example: drinking or going to bars while on probation). Some counties, however, allow for use if proper card and valid reason for use. I would consult with a lawyer who specializes in medical marijuana in your area; judges are more likely to listen to them than you!
