Dismis an inattentive driving court date

Business 5 views 3 answers
My wife got an inattentive driving ticket in Coeur d'Alene Idaho for inputting the address in the GPS. We just paid the ticket and now they told us to appear in court. It's her first ticket and we live in Washington state, Spokane. Can this case be dismissed by contacting the judge by email or mail. We're students and can not afford a lawyer.

You paid the ticket? Normally you wouldn't pay a ticket unless you plead guilty to the charge. Only infractions can be settled that way. If it's a misdemeanor case you would not have paid a fine, you would have only been able to resolve the case by appearing in Court. So I'm not sure what happened in your case. If you really paid a fine, and now they are trying to charge you with a misdemeanor, you may have a double jeopardy defense. However, I would need to know more about what happened. If you cannot afford an attorney, you can apply for the services of a public defender. I would encourage you to do that if you cannot afford to hire private counsel.

You really cannot afford to not have an attorney. We are able to prevent very negative outcomes. Also do NOT just e-mail the Judge. Good Luck

This is a misdemeanor and typically is not settled by just "paying the ticket." This is not like a speeding infraction and the case cannot be dismissed by just contacting the judge. If she does not appear or have someone appear on her behalf a warrant will likely be issued for a failure to appear.
