Public Intoxication Ticket
Anonymous2 views1 answers
I received a public intoxication ticket and was taken to jail at a college football game. I am only 20. I was wondering if I should hire an attorney now to help me get it expunged from my record, or if there was a chance that the judge will just give me community service and then it will be expunged when I turn 21? Do I need an attorney to get it expunged when I turn 21 or can I do it by myself?

It is difficult to answer this question without more information. Where did you receive this ticket? Is public intoxication a crime in your state? Or, is it just a civil forfeiture (i.e., ticket and fine)? If it is a civil forfeiture, it is unlikely that it can be expunged.
Were you already convicted? In some states, such as WI, you cannot expunge unless the court indicated expungement would be allowed at the time of your sentence.
As far as whether you should hire an attorney or handle this yourself, it is hard to answer this question unless I know where you received the public intoxication and whether the public intoxication is expungable. However, it is probably worth a free consultation with an attorney in your state.
