The amount of alimony is determined by the length of the marriage, earning capacities of the spouses and other factors. you need to retain an attorney to assist you in handling of your divorce

There are a number of statutory factors the courts must consider when determining an award of alimony. It is important to retain family law counsel to ensure the factors are applied correctly.

Your spouse cannot make you pay alimony, only a court can order it. your spouse can certainly seek alimony in a divorce complaint but this does not mean she will be awarded alimony by the court and it does not mean she is entitled to alimony. Alimony that is Ordered is paid after a divorce decree is entered by the Court. Similarly she can seek spousal support prior to a divorce decree being entered or can seek Alimony Pendente Lite (temporary maintenance support) until a divorce decree is entered. It would be in your best interest to seek legal counsel to represent your rights and discuss her possible entitlement to alimony in further detail.
