Can I serve paperwork to the other party's attorney?

I have hired an attorney who was supposed to file custody paperwork and a restraining order to the other parent (he has threaten me after I refused to drop the child support case). This was supposed to be done in early March before the child support hearing which is with in a couple of days. Since it took so long I decided to go to the court house to find out the status. Well it turns out my attorney did not file anything on my behalf (I have already paid her retainer money in February). Since I have a hearing for child support in a couple of days, I am going to file paperwork for custody/restraining order myself. My question is, can I serve that paperwork to the other parent's attorney? He is out of state and I believe he will not be here for court. Thank you.

You need to clear up this misunderstanding with your attorney. Look at your contract, did you hire the attorney for the custody and the support issues - could there be a misunderstanding about what her role is for you in the case? Did you agree to a limited scope contract? Unfortunately, if you are represented by an attorney, you may not be able to file anything in court - and you cannot serve papers since you are a party. Contact the attorney you hired and try and clear this up right away. Send her something in writing and fax it if you have to.
