IF, and I mean IF, the 'wife' was still married to another person, then she gets NOTHING. But you'll need to hire an attorney to make sure justice is served. And you BETTER be correct.

The kids might want to hire an attorney to investigate this.

I agree with my fellow barristers, but also recall this: in TX at least, many things are non-probate assets and pass by contract at the time of death. E.g., if a beneficiary is named, THAT is who gets the (life insurance, bank account, etc.). If she was not legally married to her because the marriage was void (because of bigamy or fraud), she -should- get nothing. However, if there are things in your brother's estate that pass by contract, then those things will be presumed valid. Contact a probate attorney. My sympathies.

Speak with a probate attorney. He or she can help you determine if the marriage was legal. Without a will, the estate is distributed according to Texas intestate succession laws. If the marriage was legal, the wife and the children will likely split the estate. If the marriage is not legal, the estate goes to the children, most likely.
