Returning Resident Visa - SB-1

Hello, I am asking this question on behalf of a friend. My friend's father got his Green Card almost 20 years ago then he left the U.S after that and he has been living outside the U.S till now. he has not visited the U.S not even once since the day he left. He is now around 85 years old and the entire family is living in the U.S, what are his options to come back to the U.S to live with them. Does my friend need to go through the usual immigrant petition i-130 process? Can the Returning Resident Visa - SB-1 be beneficial in his case? Thank you.

It's doubtful the SB1 would be approved since he abandoned his status. His US citizen children can petition him.

Your friend should set up a skype consult regarding this. That said, based on what you have indicated, it is more than likely the I130 route will be needed. SB-1 have low approvals and you have to show: 1. NO control over why one could return to the US (simply not wanting to travel from ones home country is not a reason.) 2. Ties to the US (family, socio-economic etc) 3. Last visit to the U Good luck.

You friend has to select and reach out to a licensed immigration counsel of one's choice to develop a workable legal plan. A broken communication using a third party intermediary will never work.
