An engagement ring is a conditional gift made in contemplation of marriage. If they do not get married, the ring is his.

Has "fiance" acknowledged paternity of the 2 year old. Is it his? Has he been ordered to pay child support? If he is not working, why not? Is he on disability? Daughter should file for child support from the father, and ex-finance should find a job, whether or not he is the father. Yes, technically she must give the ring back when the engagement is officially cancelled. Has it been cancelled? Will he sue her if she doesn't give it back? How much is it worth? What if you sue him to collect the money you loaned him to pay rent? Maybe the rent and the ring are a wash if he goes to small claims court to recover the ring. Your daughter can find a local attorney here on at the Find a Lawyer tab.

Hello, Unfortunately, in Ohio, when an engagement is broken off by either party, then the ring must be returned. The only reason it would not be returned is if your step-daughter helped to pay for all or part of it. Your stepdaughter may wish to file for child support if she has not already done so. If she has filed, then she will want to contact the child support enforcement agency or a private attorney about collecting (enforcing) the support order. If "fiance" receives disability payments, your grandchild may be entitled to a derivative benefit. I wish you both luck. Marcy Vonderwell
