I have never been in trouble. never had a record. recengly i have done something stupid and was photographed selling scrap metal i took from a job site for needed mondy. thers are no pictures of me taking it only selling it. i was charged with grand theft of 300 dollars and 2 counts of dealing in stolen property and one account of theft. for a clean record and spotless history what am i looking at and what can i expect? i have already paid for and returned one peice of property with documented proof and paid 240 dollars for the other. trying to make ammends and i have writtdn proof of all that. so what am i looking ar and what can i expect from a judge.
From the information you provided it seems like you are facing three third degree felonies and one first degree misdemeanor. If that is correct you are looking at a maximum of 16 years. I understand you are trying to make amends but be very careful because you may be making admissions that can be used against you. You could really benefit from an experience local attorney to help you get the best offer from the state.
The grand theft is a 3rd degree felony which carries 5 years in prison, the two dealing in stolen property cases are 2nd degree felonies, with 15 years in prison each. So, you are facing up to 35 years in prison. Depending upon the facts, the maximum is rarely imposed, and what you can expect is probably a number of years of probation.
I agree with Mr. De Groot (whcih is no surprise...)
The GT is a 3rd degree felony with a 5 yr max sentence; the DSPs are 2nd degree felonies with 15 yr max sentences and I don;t know what you last "one account of theft" is so I can;t say but you already have a max exposure of at least 35 years,
From your proffer - given the video and your subsequent remedial acts - it does not sound like you have a defendable case so making restitution / amends is a good thing and should help... but you need a lawyer working for you to negotiate a plea, and you have one - a PD.
You absolutely should not be throwing yourself at the mercy of the Court (unless a skilled and trained professional makes that call for strategic and informed reasons) and you will get killed negotiating with a prosecutor so sit back and let your PDF do the heavy lifting.
I know that you are contrite, are trying to do the right thing and want a favorable outcome but making admissions on a public forum is not necessarily in your interests.
So, please, pretty please, get offline and let your PD handle this.
I hope that I have been helpful in answering your question.
