You husband cannot through you out. He has no such power. He is trying to intimidate you. If he makes any threats of violence, contact police immediately.

No he can not have the police evict you. If you are in fear of him, or if he has harmed you or your child you have the right to file for a protective order and obtain use of the home and have him removed. If you file for divorce you can ask for use of the house, spousal support and child support.

You have as much right to be in the house as he does, and a court would likely say that you have more right to is, as you have a child in your care. My question to you is do you want to stay, and are you safe staying there? You may want to consider filing for a divorce and include a request for "use and occupancy" of the family home. The court would then likely order him to leave. Good luck, and stay safe.
