It's been a month since our request and no response from executor or her attorney, how long before we should request a status?

We were notified of a family statement ordered by the probate court a week before it was due as part of the probate. Refused to sign. We sent a letter requesting changes to the settlement and explained all heirs were only given 10 days notice. Probate court ordered it to be filed 90 days previous and we had no knowledge anything was being done since the passing 2 years ago. A home was what was to be sold as part of settlement. We requested a title company be used and monies dispersed at closing, also a copy of fees being paid, and all to be showed on settlement statement.

Do you currently have a probate attorney representing you? In order to make sure your interests are properly represented, I would get one as soon as possible. In the meantime, it is fine to request a status update from the executor's attorney.

If you are in a contested Probate, you need an attorney YESTERDAY! You may be able to find one who will work on a contingency (hard, but there are some). Even if you have to pay up front, you desparately need representation. A contested probate is NOT a do it yourself activity! It can cost you THOUSANDS! This is not the time to be cutting corners.

You should lawyer up. A probate lawyer may take action to compel compliance, and may also demand an accounting from the representative.
