Do I need to file a new amendment while moving back to previous client
Anonymous4 views3 answers
Hi,
I have a question regarding my H1B amendment. I have worked with a client A from Jan-2014 to July-2015 and my H1B was approved with that client . Then I moved to client B in Texas and filed an amendment and it is still in review. I moved back to Client A two weeks back. Now do I need to file a new amendment with client A when my amendment with client B is still in progress. Or is there a way that I can just withdraw the amendment filed with client B since it is not approved yet. If so can you please let me know the process to do that.
Note: The office address of Client A has been changed from last amendment and there is a distance of 11 miles from old one to new one.
Step back and know that you don't need to do anything or file anything. These are the employer's obligations, to follow the rules. Let the employer, with the assistance of their attorney, figure this one out.
Why are you asking us this question?
Have you talked to the employer's immigration lawyer and NOT a NON-ATTORNEY in HR?
If so, and you're just asking us for a 2nd opinion, please tell us what the lawyer said.

In order to work for an H-1B employer, you must be specifically authorized to do so, unless you are covered under the portabiliity provisions and have a pending application. If you transferred your H-1B from Company A to Company B, and began working for company B, this would suggest that you "ported" your H-1B visa to company B. However, if you have now returned to Company A, without first filing a new H-1B application to return to Company A, then you could have an issue. I would recommend that you discuss this situation with the company's lawyer immediately.
