Without knowing the basis for the eviction, it is not possible to state what is your first step. The best suggestion anyone could make is to hire an attorney to assist you as any wrong step could wind up with your case dismissed and you would have to start over again.

Ms. Goldstein is correct. Absent additional information, you should consult with a local landlord/tenant attorney for assistance with the eviction. The process can be very complex, and any mistake can result in you having to start all over, costing you precious time and money. Because you did not provide us with a potential basis for evicting a tenant, we cannot offer you any advice regarding the proper notice or other next steps. Best of luck!

It depends on the grounds for eviction. If non-payment, you will need to serve a 5 day. In certain cases a 10, 30 or 90 day notice is required. I highly advise you contact an attorney to save the time, money and hassle of an improper notice. Judges are very particular when it comes to the wording of the notice as well. My office along with many others here offer free initial consultation. Good luck.
