My employment based i-485 got transferred to NBC and now i am getting interview for me and my dependent. Our interview is schedules at different time. Mine is an hour before her. I had a undisclosed arrest while filling up i485 which i amended after my case got transferred to NBC. My case was never filed on court and i have supporting documents as well. I applied for i485 after a couple of months of marriage. Did this raise some eye brows? Should i be worried?

Most employment-based I-485 Applications are not scheduled for a USCIS adjustment interview. Based on the information you have provided, you are highly advised to schedule a consultation with an immigration lawyer and to retain the services of an immigration lawyer to accompany you and your wife to each of your adjustment interviews. Although filing an employment-based I-485 Application within a couple of months of getting married should not, usually, be a cause for concern, if there is any possibility that a potential conflict of interest between you and your wife might exist, as determined by a thorough consultation with an experienced immigration lawyer, then each of you should hire his or her own immigration lawyer to accompany each of you to your separate interviews at the USCIS, and do not hire the same lawyer to represent both of you.

Most employment-based adjustment of status applicants are not interviewed. However, it is not supposing that you are scheduled for an interview given you were previously arrested and initially did not disclose the arrest. You are advised to retain counsel to prepare for and attend the interview with you.

Normally, an employment based case will not be scheduled for an interview. In your case you seem to have omitted crucial information ( the fact that you were arrested) at the time of the original submission of the FORM I – 485. Perhaps that is a reason for the interview. I strongly suggest that you retain an experienced and qualified immigration attorney to review your case and to attend the interview with you.
