Without a lawyer, what are my options?
Anonymous3 views3 answers
I have been pro se in child custody court, ex refuses to abide by their end of the agreed paperwork, ex hid from me that our kids have medical issues and now ex and ex's lawyer refuse to respond to simple questions about the medical issues or provide GAL or child therapist with medical documentation or doctors names to back up claims. I'm up against parental alienation, there's no mental or physical child abuse that I'm aware of, and I'm at the point where I want to just sign my rights away to the kids, as I've had enough of my ex/ex's lawyer's bs.
You need an experienced family law attorney. This Q & A forum is insufficient for your needs. That said, if there is an order requiring this information to be produced, file a Petition for Rule to Show Cause. If there is no order, obtain one. Have you made formal discovery requests for this information? If not that is your first step. But really, you need an attorney. Your situation is not a DIY project.
you cannot sign away your rights or responsibilities unless there is an adoption case pending.
your ex's lawyer need not respond to you but must respond to interrogatories and document requests properly presented.
either hire a lawyer to help you or try to settle without one. you are at a real disadvantage if spouse has a lawyer and you do not.
While you can agree to forego involvement with the children's lives, you cannot avoid your responsibility to support your children (which is mistakenly referred to by some people as signing away their rights) unless you agree to another adult (other than the other parent) taking your place by adopting the children.
The information disclosures and abiding by any court orders are relatively simple matters to assess. You should review the status of your case with an attorney as to the issues and process, even if you are not able to retain an attorney to represent you in court.
