Not at fault car accident and want repairs w/ OEM parts.

My wife was in a not at fault car accident. State Fram is telling us that we have to use reconditioned parts or pay the diffrence. Since the accident was 100% their clients fault it seems like the repairs should be made to our satisfaction (not theirs.). to make it worse we are insurred by State Farm and they are telling us we have no options.

You do have options. Speak to a personal injury lawyer- most offer free consultations. The insurance company is trying to get out of paying you what you are owed. If you are not represented by a lawyer, State Farm will keep pushing you around. This is unfortunate but this is what insurance companies do to unrepresented claimants. State Farm has a duty to put you in a place that you were in BEFORE the accident. This includes repairs on your vehicle with genuine parts. Request your vehicle be repaired with actual parts from the manufacturer of the vehicle (not aftermarket). Remind State Farm you did not cause this accident- you are the damaged party. Speak with a local lawyer regarding your diminished value claim (if there was extensive damage). This is a little more complex, but you have a right to the full value of your car, including lost value. Good luck. Richard A. Cruz, Esq. www.cruzinjurylaw.com

No, you have a right to have genuine parts installed. Look at your policy /w State Farm & see if there's anything that governs that issue. If State Farm won't pay for the genuine parts, you'll want to escalate the matter & consult /w a local attorney.
