I am resposible for all bills, etc for my home, yes most of the income is my husbands, but he is irresponsible with money. I am in charge of it all. We are now looking to divorce, only been married for almost 5 years, but i feel I should receive spousal support, he has let me lead a certain life that will be hard to live without his income. He has put my kids and I in a bad life with attempted cheating, drug and alcohol abuse.
You should discuss your case in detail with a local divorce lawyer. The kind of analysis necessary to determine whether spousal support is likely can't be done on the limited information in a two or three sentence question.
In Michigan, the court will look at many factors in determining spousal support. Those factors include the length of the marriage, your standard of living during the marriage, the age and health of the parties, the respective earning capacity of the parties, the ability of one party to pay and the needs of the other party, and the amount and type of property awarded in the property division. In addition, the court may consider the conduct of the parties (cheating, gambling, drugs, abuse, etc...), especially if that conduct drained marital resources, even though Michigan is a no-fault divorce state.
I agree with the comment above that you should see an attorney to discuss how these factors will apply to your case. If there is significant financial disparity between the parties and you cannot afford your own attorney, you may be able to motion the court for your spouse to pay your attorney fees.
