I was rear ended by a drunk driver..

My car is totaled, I have been getting chiropractic treatments for my neck and shoulder. Long story short, I was in a desperate situation with no vehicle and a short timeline to pay off the remaining balance on my auto loan. I accepted what I thought was a decent settlement. I signed yesterday, come today, I find out I have a labral tear. Is there any way for me to get out of the settlement? Any advice is appreciated.

Probably not but contact your attorney if you had one and you should have had one in the first place. No attorney should or would settle your case until you were released by your physician.

Do now what you should have, see a local attorney. You'll probably have to see more than one since you've made this hard. Someone maybe able to argue fraud in the inducement to void the release. DO NOT CASH THAT CHECK. I got a client out of a UM release she signed two days after an accident in which she suffered a concussion. Good luck.

If you didn't sign papers don't sign, contact a member of the Alaska Trial Lawyers Assn immediately (they give free consultations). If you signed but it's in the mail, call them, fax them that you have changed your mind. Go see a member of ATLA

No, once you settle the claim, it is over and done with. That is the whole point of settling a claim. It puts it to an end. Obviously, if you would have hired a personal injury attorney to protect your interests, the attorney would never have settled the claim without first determining that you have reached maximum medical improvement and had been thoroughly vetted by your treating physicians before attempting to work any type of a settlement. Hiring an attorney would have placed you in a much better position than you are now in. All future medical care costs will be on you.

Probably not, this is why you consult with an attorney before signing a settlement agreement.
