Nolle Prosequi, after sentencing?

2 views 2 answers
I was recently sentenced on both my 1st and 2nd DUIs, in Pennsylvania. I have been on parole/Probation for both for 3 months now and i recieved a letter signed by the court entering a Nolle Prosequi for both cases. What exactly does this Mean? I thought this was only done during trial not after the sentencing is complete.

Nolle Prosequi means that the case has been dismissed. However, you would not typically receive a letter from the Court, but an Order. It is also highly irregular that such an Order would be entered after you pled guilty and were sentenced. You should have an attorney review the document you received and the docket for both cases to determine whether it was the case that was dismissed or just one or two charges as part of the plea bargain. It is not uncommon for the summary offenses to be dismissed if you pled guilty to the misdemeanor DUIs.

Mr. Cook is correct. Something is a bit off kilter here. Having an experienced criminal defense attorney review the paper work is you next step.
