Re: using my uninsured/underinsured policy

Head on collision March 2014. Blown discs Lumbar and cervical. Torn rotator cuff, massive rib bruising and some dislocations. $40,000 in bills, atty suggested I not pay one ($18,000) and take $13,000 for "my pocket" settling with other drivers minimum insurance coverage. Accident 100% her fault. After first settlement, looked through my expenses and I had paid over $6,000 out of pocket before settlement. My vehicle also continued having major issues, of which I had no recourse, so traded it in. My attorney, originally, informed me we would get a good chunk from my policy (to continue treatments that were working). Now he says the ONLY way to get anything is to have surgery (which will bring me into disability status). Isn't underinsured/uninsured there specifically to cover what the at fault drivers insurance does not? What is "pain and suffering " worth? And, as of today, I am $40,000 in the hole, lost 50% of my work hours due to accident, where the minute before the accident, was $14,000 in debt, and paying ahead of schedule. Please, any advice? What about firing my attorney and doing litigation myself?

As for new attorney perhaps. As for litigate yourself? No way. You might wish to consult with some other attorneys and see what they say. I used to be an adjuster. At one time I worked for a major carrier that wrote a commercial trucking policy. I handled all the fatalities west of the Mississippi, so I have some experience. Accidents don't settle for what people think. The big settlements are not due to great attorneys generally but to "great" injuries. Believe me you want no part of the injuries necessary for the multi million dollar settlement. But check around with some local personal injury attorneys. If any "guarantee" anything, run. Good luck.

Meet one last time with current counsel to get concrete answers and if they are as disheartening as you post seek out substitute counsel to advocate for you.
