I do not practice in NM, but I do not have to in order to answer your question. The best way to determine if a prior arrest or conviction will come up on a background check is to purchase a background check of your own. Preferably, you should use the same company your employer will, as different companies may come up with different information. (Although, it is substantially likely if you use a different company, you will get the same information anyway.) This arrest may be too recent to show up at the moment, but it is more likely to show up a month from now. Consider advising your employer of the situation now. Your employer may be more upset about the fact you did not disclose this information than the fact the arrest occurred. Good luck!

I don't practice in your state, however, you should be able to get a copy of your own criminal history by going to a police precinct or sheriff's office with your photo ID. Then you will see what employers see in a background check and answer appropriately. After you do that, please hire a good DUI attorney in your area.
